“Black Jails” a Stain on China’s Legitimacy

Earlier last week, major news outlets in China reported that a Beijing court had, for the first time, sentenced 10 Henan provincial authorities to jail for illegally detaining petitioners who had come to Beijing to air their grievances. Many China watchers, including myself, were surprised and happy to see China move in the right direction of strengthening the rule of law and depoliticizing the judicial system. The next day, however, the news was retracted; apparently no court in Beijing had made any such ruling.

The end result was quite a disappointment, especially because this brief moment of false hope is but one in a long string of depressing incidents. The illegal detention of petitioners in ‘black jails’ has long been an acute problem in the nation’s capital. According to Amnesty International and Human Rights Watch, millions of people utilize the petition system in China, often because of land disputes in which local officials illegally confiscate land and then sell it to developers for a kickback. Petitioners also seek redress of grievances against a number of other issues, including environmental damage, police abuse, and even rape. Petitioners begin with the local petition office, and if that is unsuccessful, they gradually make their way up to the provincial and national level offices. It is unknown how many people make the journey to the State Bureau for Letters and Visits every year, but it is probably in the realm of 100,000 people. Once there, many of the petitioners are ‘grabbed’ by provincial authorities and imprisoned in ‘black jails,’ before being sent back to their hometowns. The Chinese government officially denies the existence of black jails.

The problem for the CCP leadership is that much of their legitimacy in the future will rest on the government’s responsiveness to the concerns of the average citizen. But provincial authorities and the judicial system have time and again failed to live up to any minimal standard of justice. It is widely understood in China that the government and the courts serve to uphold the interests of the rich and powerful. In the past few months (and as I suspect into the next few years), “rule of law” and reforming the judiciary have been buzzwords not just among Western China experts but among the Chinese elite themselves. But this case only serves to illustrate the vacuity of official promises to reform.

I hope that I am wrong. I hope Xi Jinping and the Politburo Standing Committee make concerted efforts to crack down on the egregious abuses of power among provincial and local officials, and to provide real justice for those (mainly indigent) citizens who spend a small fortune to come to Beijing to plead their cases, only to be imprisoned and turned back. But in a system in which every instrument of power, from the military, to the state, the media, and the courts, are designed to serve the political interests of the party, how could it be otherwise?

Review of “A Contest for Supremacy” by Aaron Friedberg

Want to read the ultimate hawkish view of the US-China relationship? Read Aaron Friedberg’s recent book, “A Contest for Supremacy.” Throughout the book Friedberg emphasizes that the US-China relationship is inevitably heading down a dark road, that China is forsworn to become a hegemon and direct competitor, and that US policy is currently overweighted on the side of diplomatic engagement rather than military balancing. For a man who wants more balancing, his book is seriously unbalanced. What follows is not so much a review, but a list of grievances, in no particular order. Here’s what’s wrong with the book:

  1. Underrates internal threats to China’s rise. Friedberg mentions them briefly (demographic problems, impending environmental catastrophe, failing economic models), but doesn’t let them get in the way of predicting a Chinese juggernaut. Friedberg also sketches some possible Chinese futures, concluding that a truculent, hyper-nationalist China is more likely than either the status quo or democratic regime change. Granted, I agree with him that a hyper-nationalist China is more likely than a peaceful democratic China, but a more likely scenario than either is a future where China’s internal problems derail any of the global ambitions he ascribes to it.
  2. Mistakenly casts Chinese foreign policy thinking as more or less monolithic. Yes, no Chinese political leader currently or will likely in the future call for the demonopolization of the CCP’s power. But beyond that, there is serious political disagreement within the CCP. Economic and political reform are not settled within the party. Neither is foreign policy. The very lack of any coherent grand strategy (which Friedberg mentions) should tell him this.
  3. Underrates human leadership as making a difference in the US-China relationship. Is foreign policy merely the product of impersonal, historical forces, or can individuals play a role in shaping history? Friedberg seems to believe almost entirely in the former. I think this does not accurately reflect reality. Automatons don’t make foreign policy, human beings do.
  4. Unnecessarily combative and essentially labels everyone else defeatist appeasers. Seriously, he labels everyone who disagrees with him with these sorts of names. It’s unnecessary, especially because it’s not true. Probably no one he attacks would argue that the US shouldn’t maintain its qualitative military edge; the debate is in how to do this. He derides the idea that Sino-US cooperation can be borne on the back of issues like climate change, trade, etc. Why not? These are legitimately problematic issues, and we need China’s help to solve them, or else we are screwed. He doesn’t even mention climate change in his last chapter.
  5. Makes assertions about hypotheticals that are ungrounded from reality. Friedberg does this all over the book. The basic model is: what if China becomes a global superpower, projecting force all over the world to secure its interests, while the US de-arms, weakens, and appeases China according to our worst neoconservative fears? These are not credible hypotheticals, and they lead to baseless fear-mongering.
  6. And finally and most importantly, he underrates the effectiveness of current US policy. Throughout this entire book, Friedberg ascribes no less than the future collapse of all US interests related to China and the Asia Pacific to the Democrats and the current administration’s policies. But Democrats are not the feckless appeasers Friedberg is crudely making them out to be. Of course, just shortly after this book’s publication, the Obama administration announced the pivot/rebalance to Asia. But many of the policy proposals Friedberg advances, including the development of Prompt Global Strike and the Next-Generation Stealth Bomber, have been in the pipeline for a long time. And to be quite honest, the rebalance is not so much a quantitative shift as it is a qualitative shift; the difference is a matter of emphasis, not really a matter of resources. With or without the rebalance, US policy towards China continues a long tradition that has not been upset since the Tiananmen Massacre. It’s worked surprisingly well, and is a sound strategy going into the future.

Friedberg miscalculates both American and Chinese strategy. Engagement and balancing are not goals in of themselves; they are means to an end. That end is a peaceful, strong and rising China that is integrated into the international system. He pays lip service to this, but advocates absolutely zero proposals to make China as it is today more integrated. Everything he proposes is designed to deter the Chinese from overturning America as the global superpower. But this is also a miscalculation of Chinese strategy. China doesn’t want conflict with the US. It’s not building a military that can project force globally. It is developing relatively limited capabilities that would defeat adversaries in a Taiwan conflict and deter an American attack against the mainland. Is this going to change in the future? Very unlikely. China’s integration into the world economy, and its dependence on the US Navy to secure trade and energy shipments, make the calculus fall far in favor of peace and development. Conflict on any mass scale would cause chaos and misery for the Chinese people (think about how current CCP leaders shudder when they hear the words, “Cultural Revolution”). The CCP could very well lose power because of it. And for any foreseeable timeline into the future, the PLA would lose any conflict with the US military. Hands down.

SOEs Must be Reformed, But Whither the Political System?

The new leadership has just as many ties to state-owned enterprises as the old. The brother of Li Keqiang, who is expected to become the prime minister, is one of four deputy directors of the State Tobacco Monopoly Administration. With 98 percent of the Chinese market for cigarettes, the state-owned tobacco administration generates taxes and profits that total 7 to 10 percent of the entire revenue of the central government, according to a report in October from the Brookings Institution in Washington.

This from an article on China’s SOEs by Keith Bradsher in the New York Times. This is an insane method of revenue collection. In contrast, the U.S. federal government relies on tobacco taxes for about 0.2% of its total revenue (of course individual states make much more revenue from tobacco taxes, but it’s generally not more than 4-5%). I think it is inevitable that the new PSC will undertake some form of economic reform, particularly of SOEs, if only because such economic reform has precedent and many influential backers. I don’t see a great chance of real political reform, however. The fact that people like Jiang Zemin and Li Peng still have major influence and are sitting on the dais while Hu Jintao delivers his work report signals to me that no individual, however well intentioned, can have much of a liberalizing influence on the Chinese political system in the near future.

Mao: “cryptic, cavalier, and arguably deranged”

I’ve been reading a series of articles over the past week for my Post-1949 Modern Chinese History class, written by my professor himself, focusing on Nanjing’s experiences during the Cultural Revolution, including the January 1967 failed power seizure. The details are more complicated and confusing than I could possibly have ever imagined. I am having trouble making sense of the various actors and plot twists, but that is partially the point. Occasionally sections jump out of the page for being unintentionally hilarious:

 When Mao spoke about Nanjing during this period his utterances were cryptic, cavalier, and arguably deranged. In a meeting with military commanders on July 13 he said,

“Don’t fear chaos, the more chaos there is, and the longer it goes on, the better. The more chaos goes on, there always emerges a hall of fame, and things will clear up. No matter how chaotic, don’t be afraid. The more afraid you are, the more demons will appear. But no matter what, don’t open fire, whenever you open fire its no good. It’s not possible to have nationwide chaos. Wherever there’s a pustule, there are germs, so they’ll always pop. The chaos in the streets of Nanjing is really fierce, the more I see the happier I get. The more chaotic it gets the more there is a third faction that opposes civil war, opposes armed conflict, and that’s great! (Zhang Chunqiao interjects: “Some say the third faction will take a third road”). What third road is there! Everyone should unite, criticize, you should guide them!” (Mao Zedong 1967).

I’ve said this many times, but it’s worth saying once again: if this is the kind of material that is available now, think what will happen when the party collapses and the archives are opened up.

The Hope Still Lives and the Dream Shall Never Die

Below is a speech I gave at the Hopkins-Nanjing Center election party this morning.

Four years ago in the summer of ’08, I was an organizing fellow on the Obama for America campaign in the Manchester, NH field office (organizing fellow being a glorified name for an intern). I wouldn’t even turn 18 until that October, and it was my first campaign. It was an exciting time for a young person to be involved in politics. The most poignant time came that June, when I staffed the first joint campaign event between then candidate Obama and then gracious loser Hillary Clinton, in aptly named Unity, NH. Unity is one of those bucolic and placid rural little towns everyone thinks of when they think of presidential campaigning and New Hampshire. It has about 500 people, and about 3000 showed up for the event. Of course it was all grand political theater, if the name didn’t tip you off. A giant 50 foot American flag framed the two erstwhile competitors as they walked in for the benefit of the tv cameras. David Axelrod was standing on a grassy hill 20 yards away wearing shades, talking on his cell phone and surveying the situation. U2 was blasting on the sound system. Obama and Clinton were wearing the biggest grins of their careers, as if a grueling primary campaign had not just ended.

In that moment, I understood why people persist in working in such a blighted field as politics. The energy of the crowd and the magnetism of the speakers fed into each other in a kind of feedback loop. It was all a bit much for a very young 17-year old who, by the way, had not even started college yet.

About an hour after the event, after Obama and Clinton had left and a sudden rain had driven away the crowds, we were left to clean up. I remember walking up onto the stage, sitting on what seemed like a sacred stool, and looking out over the podium at an impossibly still scene, the same place an hour earlier that was full of such raw emotion. It felt good.

Four years later, the US and the world feel like a very different place. There’s a sense that America is searching for something that it lost, a common purpose, perhaps. Some of us feel that we’ve been collectively scarred and made impotent by the hollowing out of the American economy, ineffectual institutions, and debasing of a sense of community from a different age. But I have a feeling that America has experienced these kinds of problems before, and gotten through them. In fact, we even have a name for this continuous process of lament followed by renewal in American history: the jeremiad, named after the Biblical prophet Jeremiah. After every period of excess, we’ve always returned to the moral center, relying on traditional American values to move forward.

Some people might critique the campaign process as overly emotional. They want to rationally and logically vote for every candidate. But in a very important way, the campaign, as irrational as it is, is necessary. In the parlance of the Obama ’08 campaign, it gets us fired up, ready to go. This sort of emotional appeal represents a form of idealism that lifts us up out of the morass, and gets us working on the substantive stuff. At least in my own life, the naïveté has hopefully diminished somewhat but the optimism has never retreated. And in the words of Ted Kennedy, “The work goes on, the cause endures, the hope still lives, and the dream shall never die.”

Official Reaction to Wen Jiabao Scandal and Ningbo PX Protests Illuminating

The Chinese Communist Party (CCP) has hit some serious speed bumps in the run-up to the 18th National Congress and the highly anticipated transfer of power to Xi Jinping and a new Politburo Standing Committee. The New York Times published an investigative article exposing Premier Wen Jiabao’s estimated family fortune of  $2.7 billion, and over the past few days, protests and riots have erupted in the coastal city of Ningbo over a toxic PX (paraxylene) chemical plant.

While both are serious sources of instability, the CCP’s public responses to each have differed in important ways. As for the Wen Jiabao scandal, both the English and Chinese versions of the New York Times website were quickly blocked in Mainland China. All search terms relating to the story, including Wen’s name, have been blocked on popular twitter-like service Sina Weibo and negative references to Wen have remained sanitized from the search engine Baidu. Lawyers supposedly representing the Wen family issued a strong statement condemning the New York Times article and rebutting particular facts, and Foreign Ministry spokesman Hong Lei said the article “blackens China’s name and has ulterior motives.”

Meanwhile, the official reaction to the Ningbo PX protests has been quite different. Although Public Security Bureau (PSB) riot control squads were out in force using tear gas and batons against the crowd and making arrests, the city quickly folded Sunday evening, declaring that it would stop the PX plant from being built. Online, first person accounts of police brutality and rumors of a Ningbo University student death were suppressed; Sina Weibo even blocked photo-uploads from local Ningbo IP addresses. But the story was not censored to the same degree as the Wen Jiabao scandal. The Ningbo protests are being talked about and photos do circulate on Sina Weibo and elsewhere. The central and local governments want everyone to know that the issue had been resolved: the official announcement was trumpeted nationwide through the People’s Daily and to foreign audiences through the English-language Global Times.

What accounts for this considerable difference? In one case, the news has been thoroughly cleansed from the Internet as to make it impossible to even hear of the news. In the other case, the most egregious examples of state malfeasance have been removed, but the story itself remains. In the case of the Wen Jiabao scandal, the New York Times reporting strikes directly at the legitimacy and authority of the CCP; it goes to the very top. But cases like the Ningbo PX plant can serve as outlets for popular discontent without directly challenging the authority of the CCP.

As Rebecca MacKinnon argues in her recent book “Consent of the Networked,” netizens in China can bring attention to social injustice and can even have an impact on government policies; but ultimately these cases can serve to bolster state legitimacy when the CCP is seen as resolving the problem. There has been a raft of environmental protests recently that have been resolved in similar ways: the Shifang copper plant protests in July, Dalian PX plant protests in August 2011, and the Xiamen PX plant protests in 2007, among many others. The environment is not the only issue handled with relative kid gloves: the Party also emphasizes efforts to fight corruption in cases where the target of an anti-corruption sting is an expendable cadre; food safety is handled much the same (see the death sentences handed out as a result of the melamine tainted-milk scandal). And of course, nationalist protests are skillfully manipulated to further particular narratives and claims to legitimacy.

Hardly any of the actions of the PSB or the Propaganda Department are completely predictable during times of protest and damaging news, but there is a recognizable pattern. The Wen Jiabao and Ningbo cases are indicative of a larger truth: Chinese real-life activists and ordinary netizens are occasionally able to affect real social change in China, but they do so within the confines of acceptable political dialogue that the CCP has already laid out for them.

Modernity and the Chinese Experience

This is a piece I wrote that was just published in this month’s SAIS Observer, but it hasn’t been put online yet.

I am one of two international students in my “Modernity and World Social Thought” class at the Hopkins-Nanjing Center; the other twenty or so are all Chinese students. Every week we talk about questions of modernity and modernization: whether a country can become technologically “modernized” without being culturally and psychologically “modern”; whether modernity is a universal value or a particular value for particular people; what part, if any, of the past should persist into the era of the nation-state.

I listen when my Chinese classmates debate the influence of Confucianism in the current Chinese socio-political environment, and whether the modernizing reformers of the Xinhai Revolution of 1911 have been heeded to the present day. Most interesting to me is whether the project of modernity should have a “purpose,” whether modernity is a project or just an aimless process. Some writers, like Patrick Smith in “Somebody Else’s Century,” say none is needed. Other nationalists, like Jawaharlal Nehru, say that purpose lies in each country’s destiny. And many more say modernity’s purpose is derived from individual human fulfillment.

This question bites directly into the seminar and indeed many of my Chinese peers’ experiences. A century ago, China grappled over whether it could preserve its unique cultural ti (fundamental principles) while grafting onto it Western yong (practical application). Yong is the means, ti is the end. China is still dealing with this rift between ti and yong today. This separation is reflected in a number of common questions, like: what makes our state legitimate? What are our national values? Are we permanently stuck in a culture of material consumption, or is there a way forward?

Mao Zedong said at the outset of the People’s Republic, “Our new China is like a blank piece of paper on which we can write the most elegant characters and paint the most beautiful pictures.” In modern China, the question is not so much how to preserve the Confucian ti, but rather how to come up with a new ti after it has been thoroughly scarred from being scooped out and replaced, over and over again.

But then I focus on the reality of class discussion. I realize that, more than anything else, this small seminar, existing in a tiny bubble within China, is through its own way living out the project of modernity.  We are living out modernity through discussion; the classroom dialectic is perhaps the only way to move forward past confusion and post-modernism. Values are not objects for individuals. They are decided in common. And if we can do our small part in tackling such immense problems, especially in a place like China, then I will be happy.

Duan Weihong, a wealthy businesswoman whose company, Taihong, was the investment vehicle for the Ping An shares held by the prime minister’s mother and other relatives, said the investments were actually her own. Ms. Duan, who comes from the prime minister’s hometown and is a close friend of his wife, said ownership of the shares was listed in the names of Mr. Wen’s relatives in an effort to conceal the size of Ms. Duan’s own holdings.

“When I invested in Ping An I didn’t want to be written about,” Ms. Duan said, “so I had my relatives find some other people to hold these shares for me.”

But it was an “accident,” she said, that her company chose the relatives of the prime minister as the listed shareholders — a process that required registering their official ID numbers and obtaining their signatures. Until presented with the names of the investors by The Times, she said, she had no idea that they had selected the relatives of Wen Jiabao.

The New York Times’ expose on Wen Jiabao’s family fortune is nothing but incredible, but the details are just completely absurd and at times hilarious. For example, if you were a shell investor for Wen Jiabao’s family, why in the world would you ever allow yourself to be interviewed by the New York Times?! The above passage is mind-blowing.

Libyan Islamist Incidentally Freshly Recreates Deliberative Democracy

“We used to think that removing oppression and imposing justice are the same thing, but justice requires dialogue,” Mr. Qaid added. In prison, he said, he and many of his fellow Islamist inmates decided that just as they rejected Colonel Qaddafi’s suppression of dissent, they should never try to impose their own views on others. “We want to derive our way of life from the teachings of our religion, without forcing anyone else to do it,” he said. “These are the principles that never change.”

The whole article in the New York Times also has some very useful suggestions for American policy makers on not treating all combat-age Muslim teenagers as enemy combatants.
